Terms of use:

• SCHEDULING. Our photographers strive to be punctual, but we recommend allowing a window of +/- 15 minutes to account for potential traffic and unforeseen circumstances. Your understanding and flexibility are appreciated as we aim to provide the best possible service. To encourage cooperation on site, please make homeowners aware of the length of the appointment.

• HOME STAGING. To facilitate a smooth photography session, it is essential that the property is entirely ready for photography upon the photographer's arrival. Kindly ensure that all staging, adjustments, and styling are concluded prior to the scheduled session, as our photographers operate on strict schedules with multiple appointments. Please note that photographers may not be able to wait for delays and a follow-up appointment may need to be booked at additional cost. • ARTISTIC STYLE. The Client acknowledges familiarity with Stylish Detroit's portfolio and seeks our Services with an understanding of our evolving artistic style. Acknowledging the unique and creative nature of our work, Clients recognize that resulting photographs may differ from prior works, and we exercise artistic judgment to align with our distinct vision, which may differ from the Client's or the Homeowner's perspective. Therefore, the photos are not subject to rejection based on taste or aesthetic considerations. While we strive for accurate representation, precise color matching for walls and furnishings exceeds the scope of real estate photography. Designers and builders who need this level of service are encouraged to explore our commercial pricing for interior design shoots.

• PHOTO DELIVERY. We are committed to your satisfaction and diligently strive to provide you with exceptional results. Images will be delivered electronically and include both MLS-sized photos and larger files suitable for various online platforms such as blogs, websites, and Facebook. Upon request, full resolution downloads are available, specifically suited for printed materials like brochures.

We offer a 5-day window for you to notify us of any concerns or dissatisfaction. Given the swift turnaround for real estate media and its intended usage, we consider this timeframe essential. After 5 days, we assume the job has been completed to your satisfaction, and we may not be able to accommodate concerns or requests. Please review our ARTISTIC STYLE statement above.

Please note that additional retouching fees may apply for some requests. An estimate will be provided for approval prior to work commencing.

Photos, services, property websites, marketing kit materials, and custom website addresses (custom website URLs) will be conveniently accessible via Stylish Detroit's online client portal for a duration of one year (365 days) from the project's shoot date. If the Client wishes to continue the access beyond this initial year, a renewal fee applies. Informing Stylish Detroit before the year's completion enables the renewal of photos, videos, and property websites for an additional year. It's important to note that beyond the initial year, Stylish Detroit is not obliged to store the media in the absence of renewal. On a case-by-case basis, Stylish Detroit may be able to retrieve media assets that were removed from our online portal, but a fee will apply for retrieval and this process may take 7-14 days. We make no guarantees that assets retired from the online portal can be retrieved.

• SHOOTABLE SPACE. Our pricing structure reflects the total shootable square footage, encompassing spaces that might not be accounted for in MLS records, such as below-grade living areas. To ensure seamless coverage, kindly schedule your session based on the shootable square footage. This is pivotal as the home's size determines the allocated appointment duration. Selecting an appropriate package is essential to capture the property comprehensively in a single session. Typically, we exclude interior shots of garages, small walk-in closets, and unfinished basements, unless specifically requested. If you have specific inclusions or exclusions, kindly specify them in your booking notes or communicate them to your photographer.

• PAYMENT. To facilitate a seamless process, images will only be released and licensed for usage upon receipt of full payment. Images and most products other than video are delivered the next business day. Payment can be made online at the time of booking or when you receive email notification that your images are ready for delivery. Please be aware that electronic/web payments are not accepted on-site, and our photographers are not authorized to collect payments.

• AREA OF SERVICE. Shoots requested outside of a 30 Mile Radius from Detroit may be subject to a mileage surcharge.

• ACCESS & SECURITY. The Client acknowledges the necessity of promptly granting access to the property at the appointed time for Stylish Detroit's services. In instances where the Client won't be present on-site, it's the Client's responsibility to ensure access via means such as a lockbox, keycode, or equivalent methods. Please note that a cancellation fee is applicable for appointments at properties where access cannot be obtained, and Stylish Detroit is not liable for any delay/cancellation, or missing footage resulting from the Client's failure to provide timely and functional access information, including gated community codes, keys or codes to access on-site amenities, concierge or security permissions, or other prerequisites. We retain the right to cancel an appointment if we arrive at an unsecured property and have safety concerns.

• TENANT OCCUPIED PROPERTIES. The presence of the homeowner or agent is required at any tenant occupied property. Stylish Detroit cannot be held responsible for any areas not photographed due to denied access by tenants. If a tenant declines access to the entire property, it will be considered an on-site cancellation. We prioritize safety and in situations where our photographers feel unsafe during a shoot, they have the right to terminate the session.

• HAZARDOUS CONDITIONS. Our priority at to ensure the safety and well-being of our team members while providing top-notch service to our clients. We recognize that certain properties may present hazardous conditions that can compromise the health and comfort of our personnel. We ask clients to be mindful of potential hazards and any unremedied hazards must be disclosed at the time of booking, so a determination can be made if we can provide service.

Common hazards that should be addressed prior to the photographer arriving include, but are not limited to:

- Insect infestations or the presence of dangerous insects/animals including bugs, fleas, ticks, active hives on the property, cockroaches, rodents, etc.

- Unsanitary conditions resulting from excessive dirtiness, hoarding, the presence of animal or human waste, and/or biohazards.

- Air quality issues caused by mold, excessive smoke, recent drug use, fire, etc.

- Indoor temperatures exceeding 90ºF or below 40ºF.

- Outdoor hazards due to poison ivy, poison oak, uncleared brush, pits, open wells, etc.

- Structural instabilities that could lead to a fall/injury, gas leaks, or any other potential hazard.

By booking a photography session, client asserts that property does not pose a potential danger to any representative of Stylish Detroit and understands a Stylish Detroit team member can cancel or end a shoot at any time if they feel their safety is compromised. We reserve the right to take appropriate action to protect our team members. This may include rescheduling the visit, utilizing protective equipment, or employing alternative methods to capture the desired media content. Client agrees that some parts of a job may not be completed if a hazard is present.

• PETS. We are a pet friendly company and enjoy meeting pets, but for the best quality real estate photos, pets should not be present in the rooms being photographed. We kindly request that pets are appropriately restrained while photo shoots and other services are in progress. If there are aggressive animals on-site, we require the homeowner's presence during our services to ensure a safe environment for all involved. Stylish Detroit is not responsible for any missing shots/footage due to pets left in yards unattended.

Cancellations:

24 hours notice is required for cancellation or re-scheduling, which can be done right in the booking account or from your confirmation email. If a video or photo shoot appointment is canceled within 24 hours of the appointment, a 25% booking fee will be assessed and invoiced on the total booked. Bookings cancelled within 3 hours of a shoot or on location will be assessed and invoiced 60% of the total of services booked and any incurred mileage. Stylish Detroit reserves the right to cancel any scheduled and confirmed shoot at any time. You will be notified immediately and the cancelled shoot will be re-scheduled.

COPYRIGHT & USAGE NOTICE:

Stylish Detroit maintains the copyright for all images. Unauthorized use is prohibited by Federal Law.

Real estate media clients of Stylish Detroit are permitted to use all photos produced for all marketing associated with the current sale of property in accordance to local MLS/Syndication rules, unless other licensing has been outlined in writing. The terms of this license expires when the listing is sold or agreement terminated. This license is granted only to the AGENT/TEAM who has requested the photo/video shoot. THIRD PARTY USAGE AND COMMERCIAL USAGE including, but not limited to, architects, builders, stagers, designers, publications, sellers or buyers is prohibited unless approved in writing by Stylish Detroit. (Note: If your listing expires, it is a copyright violation for another agent to use the photos you commissioned without the permission of StylishDetroit. In this event, please contact us AND the MLS.)
